Overseas Travel Terms and Conditions
Governing Law These terms and conditions are governed by the laws of the Republic of Korea. Any disputes arising from these terms shall be resolved in accordance with Korean law, except as otherwise provided herein. Article 1: Purpose These terms and conditions are established to define the rights, obligations, and responsibilities related to overseas travel between ‘Square Group Co., Ltd.’ (hereinafter referred to as ‘the Company’) and domestic citizens or foreign residents residing in Korea (hereinafter referred to as ‘Travelers’). Article 2: Duties The Company, as a registered travel agency under the Ministry of Culture and Tourism, is responsible for planning, consulting, reserving, arranging, guiding, and facilitating all aspects of overseas travel for Travelers, including the calculation and settlement of travel expenses. The Company is committed to providing courteous and professional service with integrity and sincerity. Article 3: Formation of Travel Contract 1. A travel contract is established when a Traveler applies for overseas travel with the Company by verbal, telephone, written, or electronic communication, and the Company provides confirmation. The contract becomes effective upon payment of the deposit by the Traveler. 2. Travelers must thoroughly review and agree to the Company’s travel terms and conditions before entering into the contract. Article 4: Insurance 1. The Company may recommend that Travelers purchase travel insurance for their own safety, particularly if the travel package does not include such coverage. 2. In the event of any damage or loss incurred by the Traveler without the Company's fault (including cases specified in Articles 11(6), 14(3), and 14(4)), compensation will be handled in accordance with the insurance policy terms. 3. Travelers or their beneficiaries must immediately notify the insurance company of any accidents, illnesses, or other incidents and provide the necessary documents requested by the insurer. Article 5: Travel Expenses 1. Travelers must pay the full travel cost at least 6 weeks prior to the trip. 2. Travel expenses include, but are not limited to: o Transportation costs as specified in the itinerary. o Accommodation fees (hotels, lodging facilities). o Meal expenses specified in the itinerary. o Educational and activity fees included in the program. o Airport meet-and-greet and farewell services. o Fees paid on behalf of Travelers to educational institutions (educators), hotel accommodation, venue rental, travel agency services, and airport pick-up services. 3. Travel expenses do not include: o Personal expenses (communication fees, customs, tips, laundry, personal food and drinks). o Medical expenses for illnesses, injuries, or other health-related costs during the trip. o Costs exceeding the standard services specified in the itinerary. o Any fees not explicitly mentioned in the itinerary. o Travel procedure fees (passport fees, visa fees). Article 6: Refusal of Travel Participation 1. The Company reserves the right to deny travel applications from individuals who do not meet the eligibility criteria under Korean law, or who may disrupt the smooth operation of the trip due to violations of public order, social norms, or legal regulations. 2. If a Traveler violates international law, public order, or social norms during the trip, the Company may terminate their participation immediately. 3. Travelers under the age of 18, seniors (including those with heart conditions, hypertension, or other medical issues), or those with disabilities must notify the Company of their condition prior to travel. The Company reserves the right to refuse participation if it is determined that such conditions may interfere with the trip. 4. The Company may refuse participation if a Traveler's application is found to be illegal, fraudulent, false, or in violation of these terms and conditions. Article 7: Changes to Travel Conditions 1. Travel conditions are generally fixed once the trip begins, except in the following cases: o If both parties mutually agree to the change for the safety and smooth operation of the trip, or due to local circumstances. o If unforeseen circumstances arise, including but not limited to natural disasters, accidents, government orders, public directives, civil unrest, wars, strikes, hijackings, or other extraordinary situations affecting travel. Article 8: Termination of Travel Contract 1. The Company may terminate the travel contract under the following circumstances: o If travel cannot be carried out due to unavoidable circumstances such as natural disasters, unforeseen accidents, civil disturbances, strikes, or aircraft hijacking. o If the Traveler engages in conduct that violates domestic laws, public order, or social norms, or otherwise interferes with the smooth operation of the trip. o If the number of participants does not meet the minimum required for the planned group travel, and the Company notifies the Traveler at least 8 weeks prior to departure. o If the Traveler is unable to continue the trip due to injury or illness after the contract is established. o If the Traveler violates the terms of the travel contract. Article 9: Refund of Travel Expenses 1. Refunds for travel expenses shall be provided if a refund-eligible situation arises during the trip. 2. If the travel contract is canceled by the Traveler, refunds will be made according to the cancellation fees specified in Article 11(1). The remaining balance will be refunded promptly. 3. If a Traveler’s situation falls under Article 6 (2) or (4), any fees for unused services during the trip will not be refunded. 4. If a change occurs under Article 7 or 8, and the revised cost is lower than the original cost, the difference will be refunded. If the revised cost is higher, the Traveler must pay the difference. 5. If the trip is canceled before it begins (as per Article 7(2)), a full refund will be provided. If the trip is canceled after it begins, refunds will be issued for unused services only. 6. No refunds will be provided if a Traveler cannot use the services included in the travel package (accommodation, meals, tours) due to personal reasons after the trip begins. Article 10: Breach of Contract 1. If the Company violates the terms and conditions of this contract, it shall be liable for any damages or losses incurred by the Traveler. 2. The Company is obligated to compensate the Traveler for direct damages resulting from the breach, unless such damages were caused by force majeure or reasons beyond the Company's control. Article 11: Cancellation Fees and Compensation 1. If the Traveler initiates the cancellation of the travel contract, the following cancellation fees will apply: o 8 weeks before departure: Full refund of travel expenses (excluding the deposit). o 6 weeks before departure: 70% refund of travel expenses (excluding the deposit). o 4 weeks before departure: 50% refund of travel expenses (excluding the deposit). o 3 weeks before departure: No refund. 2. If the Company cancels the travel contract, the Company will refund the deposit and compensate for any airline cancellation fees. If the cancellation is due to the minimum number of participants not being met, the Company will compensate in accordance with Article 4. 3. Exceptions: In the event of the death of a Traveler’s relative within the third degree, the following documents must be submitted: o Proof of kinship (e.g., family registration certificate). o Death certificate or medical certificate. 4. If the Traveler is unable to participate due to serious illness or injury, the following documents must be submitted: o Medical certificate. o Any other necessary documents. 5. If the Company cancels the travel contract, it may recommend an equivalent or similar product from another travel agency. If the Traveler accepts the alternative, no cancellation fee will be charged. 6. The Company is not responsible for compensation in cases of force majeure, including natural disasters, unforeseen accidents, government orders, public directives, wars, strikes, hijacking, theft, fraud, assault, injury, or infectious diseases. Article 12: Responsibilities of the Company 1. The Company is responsible for performing the travel contract with sincerity and integrity, ensuring the safety and convenience of Travelers. The Company’s staff will typically accompany Travelers, unless otherwise specified in the confirmed itinerary. 2. If the Company cancels or terminates the travel contract due to reasons attributable to the Company (as specified in Article 11(5)), it may recommend an equivalent or similar travel product offered by another agency. 3. In cases where compensation is required due to reasons specified in Article 11(6), the Company will actively cooperate with the insurance company to facilitate compensation and mediation for Travelers. 4. If the Company or its educational partners cause damage to Travelers due to intentional or negligent actions during the execution of the travel contract, the responsible party must compensate the Traveler for the resulting damages. Article 13: Responsibilities of Travelers 1. Travelers must cooperate sincerely with the Company's staff and educational institution representatives to ensure the smooth operation of the trip. 2. Travelers are responsible for compensating the Company for any damages caused by their intentional or negligent actions. 3. Travelers are responsible for safeguarding their own valuables and personal belongings. In the event of theft or loss during the trip, Travelers or the insurance beneficiaries must immediately notify the insurance company and submit the following documents: o Theft Report o Statement of Circumstances o Any other required documents 4. Travelers are responsible for any issues arising from pre-existing physical disabilities or illnesses that were not disclosed to the Company before the contract was signed. In the event of a physical disability or illness occurring during the trip, Travelers or the insurance beneficiaries must immediately notify the insurance company and submit the following documents: o Accident Report o Medical Certificate o Statement of Circumstances o Receipts o Any other necessary documents Article 14: Commencement and Termination of Travel Travel shall commence at the time of the Traveler’s arrival at the destination on the scheduled start date and shall terminate upon departure from the accommodation at the end of the travel itinerary. However, exceptions may apply if the travel contract or itinerary is modified. Article 15: Jurisdiction Any disputes arising between the Company, Travelers, or any other parties concerning the interpretation, performance, or termination of this contract, or the refund of travel expenses, shall be exclusively subject to the jurisdiction of the Seoul District Court.
